Terms and Conditions

Please read these Terms before submitting an inquiry, requesting a quote, confirming a booking, or making a payment. By proceeding with a booking or payment, you confirm that you have read, understood, and accepted these Terms, together with our Privacy Policy and Cancellation & Refund Policy.

1. Legal Identity and Brand Relationship

Macua Tours is a registered trade name of Origami Passage Holdings LLC, a limited liability company organized under the laws of the State of Wyoming, United States.

 

Macuá Tours is the public-facing brand style used with travelers. For legal, banking, tax, payment, and administrative purposes, the trade name may appear as Macua Tours, without the accent. References to “Macua Tours,” “Macuá Tours,” “we,” “us,” or “our” in these Terms refer to Origami Passage Holdings LLC, doing business as Macua Tours.

Registered mailing address for formal notices: 30 N Gould St Ste N, Sheridan, WY 82801, United States. This registered mailing address is used for formal business notices. It is not a walk-in customer office.

2. What Macua Tours Does

Macua Tours is a private travel coordination company serving Costa Rica, Nicaragua, and neighboring destinations for international travelers.

 

We coordinate private transfers, day trips, private tours, birdwatching day tours, birdwatching packages, surf trips, overnight tours, multi-day packages, and custom itineraries. Our role includes client communication, quote preparation, booking coordination, payment administration, itinerary planning, provider coordination, and operational support before and during the service.

 

Transportation, guiding, lodging, surf instruction, birdwatching guiding, activity operations, meals, boats, local support, and other on-the-ground services are delivered by independent local providers selected for each booking. Macua Tours does not directly own, operate, or employ those providers.

3. Acceptance of These Terms

By submitting an inquiry, requesting a quote, confirming a booking, submitting payment, or using any service coordinated by Macua Tours, you confirm that you have read, understood, and accepted these Terms.

 

If you book on behalf of a family, group, company, or another traveler, you confirm that you are authorized to accept these Terms on their behalf and that all travelers in the booking are aware of and bound by them.

 

If you do not agree with these Terms, do not proceed with a booking or payment.

4. Website Use and Information Accuracy

The content on macuatours.com is provided for general travel planning, service information, and booking support. Website descriptions, route information, travel times, sample itineraries, photos, and service descriptions are informational and may vary depending on weather, road conditions, border procedures, supplier availability, seasonality, and local operating conditions.

 

 

A written quote or booking confirmation issued by Macua Tours controls the specific services, dates, route, included items, exclusions, price, and special conditions for your booking.

 

You may not use the website or our communications channels for unlawful purposes, scraping, unauthorized copying, fraud, harassment, abusive conduct, or interference with website security or performance.

5. Booking Process

A booking normally follows this process: inquiry, quote, written confirmation request, payment through the payment method or payment link provided by Macua Tours, supplier availability review, and written booking confirmation issued by Macua Tours.

 

A booking is not confirmed until Macua Tours sends a written booking confirmation. Payment alone does not guarantee supplier availability unless and until Macua Tours confirms the booking in writing.

 

Verbal conversations, WhatsApp messages, draft itineraries, price estimates, availability checks, or payment links do not create a confirmed booking unless Macua Tours issues a written booking confirmation.

 

Macua Tours may decline or cancel an unconfirmed booking request before written confirmation is issued, including when supplier availability changes, the requested service is not operationally feasible, payment cannot be verified, or the request falls outside our service model.

6. Quotes, Prices, Currency, and Exclusions

All prices are quoted in United States Dollars (USD) unless Macua Tours states otherwise in writing.

 

Quoted prices apply only to the services expressly listed in the written quote. Unless expressly included, prices do not include international airfare, domestic flights, travel insurance, government taxes or fees, visa fees, border entry or exit fees, meals outside the written itinerary, personal expenses, gratuities, optional activities, hotel incidentals, medical expenses, or costs caused by traveler delays or document issues.

 

Quotes may be subject to expiration, supplier availability, seasonal changes, currency changes, route changes, fuel- related changes, accommodation availability, and itinerary adjustments. If a quote has an expiration date, Macua Tours is not obligated to honor the quote after that date unless confirmed in writing.

 

If a supplier imposes special terms, non-recoverable costs, or stricter cancellation terms for a specific hotel, activity, route, surf service, birdwatching guide, or custom itinerary component, Macua Tours may include those terms in the written quote or booking confirmation. Those specific written terms apply to the affected booking component.

7. Payment Terms and Billing Descriptor

Payment may be required in full or as a deposit and balance, depending on the service type, supplier requirements, service date, and written quote. Deposit amounts, balance due dates, and payment deadlines will be stated in the written quote or booking confirmation when applicable.

Payment is processed through third-party payment processors, banks, payment platforms, or payment links. Macua Tours does not store full card numbers or full banking credentials on its own website servers.

Bank, card network, currency conversion, international transfer, or payment platform fees may apply. Where such fees are known and applicable, they will be disclosed in the quote, payment instructions, or relevant policy. Refunds are governed by our Cancellation & Refund Policy.

Your bank or card statement may show Origami Passage Holdings LLC, Macua Tours, a payment processor name, or another descriptor associated with the payment platform used. If you do not recognize a charge, contact [email protected] before initiating a bank dispute so we can help identify the transaction. 

8. Cancellation, Refunds, Rescheduling, and No-Shows

Cancellations, refunds, rescheduling requests, no-shows, services already commenced, traveler documentation issues, denied boarding, denied entry, operator-initiated cancellations, transaction fees, non-recoverable supplier costs, and force majeure are governed by the Macua Tours Cancellation & Refund Policy.

The Cancellation & Refund Policy is incorporated into these Terms by reference and is available at Cancellation and Refund Policy.

Cancellation requests must be submitted in writing to [email protected]. Operational WhatsApp messages or requests directed only to local providers do not replace the cancellation process described in the Cancellation & Refund Policy.

9. Client Responsibilities

You are responsible for providing accurate and complete information required for quote preparation, booking, payment, pickup, drop-off, route planning, accommodation coordination, border support, and safety.

 

You are responsible for ensuring that all travelers have valid passports, visas, entry permits, onward travel documents, parental consent letters for minors when required, and any other documentation required by Costa Rica, Nicaragua, or any other country in your itinerary.

 

You are responsible for arriving on time at pickup points, meeting locations, hotel lobbies, airports, docks, borders, activity sites, and any other confirmed meeting place. Delays caused by the client may result in waiting charges, service changes, missed services, or forfeiture without refund under the Cancellation & Refund Policy.

 

You are responsible for informing Macua Tours in advance about relevant health, mobility, accessibility, dietary, allergy, medical, age-related, surf experience, swimming ability, or safety information that may affect trip coordination or activity suitability.

 

You are responsible for complying with local laws, border rules, customs rules, park rules, lodging rules, supplier safety instructions, and reasonable instructions from drivers, guides, activity providers, lodging staff, authorities, and Macua Tours.

10. Cross-Border Travel and Government Decisions

Some services involve travel between Costa Rica, Nicaragua, and neighboring destinations. Border crossing rules, entry requirements, exit requirements, fees, document requirements, travel authorizations, customs procedures, and government decisions can change without notice.

 

Macua Tours may provide general orientation and coordination support based on field experience and available information. However, Macua Tours cannot guarantee entry into or exit from any country. Immigration, customs, police, health, aviation, maritime, and other government authorities make their own decisions independently.

 

Macua Tours is not responsible for denied entry, deportation, delays, missed services, additional costs, route changes, fines, confiscations, or disruptions caused by incomplete documents, inaccurate traveler information, government decisions, border closures, changed rules, restricted items, or traveler non-compliance with applicable requirements.

 

If your itinerary involves drones, professional equipment, medications, animal products, plants, restricted items, large sports equipment, unusual luggage, or regulated goods, you are responsible for verifying import, export, customs, airline, and border requirements before travel.

10.1 Traveler Documents, Denied Boarding, Denied Entry, and Service Forfeiture

Travelers are solely responsible for verifying and carrying all documents required to board flights, enter each destination country, cross land borders, re-enter a prior country, and continue onward travel. These documents may include, without limitation, a valid passport, visas, tourist cards, entry authorizations, proof of onward or return travel, proof of sufficient funds, parental authorization for minors, vaccination certificates, health documents, and any other requirement imposed by airlines, immigration authorities, customs authorities, health authorities, border officials, or other government agencies.

 

Macua Tours may provide general reminders or operational guidance based on the information available to us, but such guidance does not replace the traveler’s responsibility to verify current official entry, exit, health, visa, vaccination, passport, airline, and border requirements before travel.

 

If a traveler is denied boarding, denied entry, refused exit, delayed, detained, turned back, or prevented from continuing the itinerary because of missing, expired, invalid, incomplete, inaccurate, or non-compliant documents, lack of proof of onward or return travel, lack of required vaccination documentation, government restrictions, airline requirements, customs decisions, health regulations, border decisions, or any other traveler-side compliance issue, Macua Tours will not be responsible for the resulting loss, delay, missed service, additional cost, or itinerary disruption.

 

If Macua Tours or an independent local provider has already reserved, dispatched, committed, or made available a driver, guide, vehicle, border host, activity provider, lodging provider, or other service component for the scheduled booking, and the traveler cannot use the service because of any issue described in this section, the unused service may be treated as a no-show or as a service already commenced, depending on the stage of the itinerary. In such cases, no refund will be owed except where required by applicable law or expressly stated otherwise in the written booking confirmation.

 

If a traveler is unable to continue after arriving at an airport, land border, dock, hotel, pickup point, or other scheduled meeting location, any additional transportation, return transfer, rerouting, lodging, waiting time, guide time, border assistance, or alternative service will be quoted separately and must be paid by the traveler before it is arranged, unless Macua Tours agrees otherwise in writing.

 

Examples include, but are not limited to, failure to present proof of onward or return travel when requested by immigration authorities, failure to carry a passport or travel document accepted by the destination country, insufficient passport validity for the destination, airline, immigration authority, or border authority, lack of a required visa or entry authorization, lack of a required yellow fever vaccination certificate when applicable, pandemic-related or health-related entry rules, customs restrictions, airline boarding requirements, or denial of entry by immigration or border authorities.

 

Government, immigration, customs, health, airline, and border decisions are outside the control of Macua Tours and independent local providers.

11. Independent Local Providers

Macua Tours coordinates services through independent local providers, including transportation providers, drivers, guides, birdwatching specialists, surf instructors, lodging providers, boat operators, restaurants, activity operators, border support providers, and other local service providers.

 

These providers are independent businesses or independent professionals. They are not employees, agents, representatives, subsidiaries, joint venture partners, or legal affiliates of Macua Tours or Origami Passage Holdings LLC.

 

Where applicable, independent local providers are responsible for their own vehicles, equipment, staff, permits, licenses, insurance, safety practices, maintenance, operating decisions, and compliance with local law.

 

Macua Tours selects local providers based on field experience, service fit, reputation, operational history, availability, communication, and prior client feedback. However, Macua Tours does not control every aspect of how independent providers perform on-the-ground services.

 

By booking with Macua Tours, you acknowledge that on-the-ground services are delivered by independent local providers selected for the booking, while Macua Tours remains your coordination and communication point for the booking.

12. Assumption of Travel and Activity Risks

Travel in Costa Rica, Nicaragua, and neighboring destinations may involve risks that cannot be fully eliminated, including road conditions, weather, border delays, tropical heat, ocean conditions, uneven terrain, wildlife, insects, remote areas, boat transfers, traffic, ferry schedules, volcanic activity, rain, landslides, power outages, and limited medical access in certain locations.

 

Surf trips, birdwatching experiences, volcano visits, boat activities, beach activities, hiking, wildlife observation, and other nature-based or adventure services may involve additional physical and environmental risks.

 

By booking services that include these environments or activities, you acknowledge that such risks are part of travel and outdoor activities. You agree to follow safety instructions and to make responsible decisions based on your own health, fitness, experience, and comfort level.

 

Macua Tours may refuse to coordinate or continue an activity if safety, weather, water conditions, supplier judgment, park rules, government rules, or traveler behavior makes the activity unsuitable.

13. Changes to Itineraries, Routes, Times, and Providers

Macua Tours may modify routes, pickup times, activity order, suppliers, stops, hotels, guides, vehicles, or itinerary details when reasonably necessary due to weather, road conditions, border delays, safety concerns, supplier changes, availability, government restrictions, force majeure, or other operational circumstances.

 

When a material change is required, Macua Tours will make reasonable efforts to notify you and provide a comparable alternative where available. A change made for safety, availability, or operational reasons does not automatically entitle the client to a refund if the service can still be delivered in a materially similar way.

 

Client-requested changes are subject to supplier availability, price changes, additional costs, route feasibility, and the Cancellation & Refund Policy. No change is confirmed until Macua Tours confirms it in writing.

14. Luggage, Personal Property, and Special Equipment

You are responsible for your luggage, passports, phones, cameras, laptops, surfboards, binoculars, drones, cash, jewelry, medications, travel documents, and other personal property.

 

Macua Tours and independent local providers are not responsible for lost, stolen, delayed, forgotten, damaged, or confiscated personal property except where liability cannot be excluded under applicable law.

 

You must inform Macua Tours in advance if you will travel with oversized luggage, surfboards, bicycles, diving equipment, photography equipment, drones, mobility devices, fragile items, or unusual baggage. Additional charges, vehicle changes, supplier approval, or route limitations may apply.

15. Conduct and Safety

Macua Tours and independent local providers may refuse, suspend, or terminate service if a traveler creates a safety risk, behaves abusively or aggressively, appears intoxicated or impaired, refuses to follow safety instructions, harasses providers or other travelers, damages property, violates local law, or disrupts the service.

 

In those circumstances, no refund will be issued for unused portions of the service unless required by applicable law.

Travelers are expected to treat drivers, guides, hotel staff, activity providers, local communities, authorities, and other travelers with respect.

16. Limitation of Liability

To the fullest extent permitted by applicable law, Macua Tours and Origami Passage Holdings LLC are not liable for losses, injuries, illness, death, property damage, delays, service interruptions, or other harm caused by independent local providers, government authorities, airlines, hotels, activity operators, transportation providers, weather, road conditions, border procedures, traveler conduct, or circumstances beyond our reasonable control.

 

To the fullest extent permitted by applicable law, the total liability of Macua Tours and Origami Passage Holdings LLC for any claim arising from or related to a booking is limited to the amount paid by the client to Macua Tours for the specific service component directly giving rise to the claim.

 

Macua Tours is not liable for indirect, incidental, special, punitive, or consequential damages, including but not limited to lost vacation time, emotional distress, missed flights, lost business opportunities, alternative travel arrangements, meals, airfare, accommodation outside the booked service, visa fees, travel insurance premiums, or other ancillary costs.

 

Nothing in these Terms limits any non-waivable rights, remedies, or protections that may apply under applicable consumer protection law.

17. Travel Insurance

Macua Tours strongly recommends that every traveler purchase comprehensive travel insurance before travel.

 

Recommended coverage includes trip cancellation, trip interruption, emergency medical treatment, emergency evacuation, personal accident, baggage loss or delay, travel delay, missed connections, and coverage for activities such as surfing, hiking, birdwatching, boating, wildlife viewing, and cross-border travel where relevant.

 

For higher-value custom itineraries, multi-day packages, surf trips, birdwatching packages, or services involving non- recoverable supplier commitments, Cancel For Any Reason coverage may be worth considering where available.

 

Macua Tours does not currently sell or arrange travel insurance. The absence of travel insurance does not change these Terms or the Cancellation & Refund Policy.

18. Privacy, Data Sharing, and International Transfers

Macua Tours collects and processes traveler information as described in our Privacy Policy, available at: https://macuatours.com/privacy-policy/.

 

By requesting a quote, booking a service, submitting traveler information, or making a payment, you authorize Macua Tours to process and share the information reasonably necessary to coordinate your trip, including with independent local providers, payment processors, banks, technology providers, and professional advisors when needed.

 

For services in Costa Rica, Nicaragua, and neighboring destinations, necessary traveler information may be transferred internationally and shared with local transportation providers, guides, hotels, activity operators, border support providers, and other providers involved in the service.

You are responsible for obtaining consent from any traveler whose information you submit to Macua Tours, including minors and members of your group.

19. Photos, Reviews, Testimonials, and Marketing Content

If you send us a review, testimonial, photo, video, or feedback, Macua Tours may ask for permission to use it for website, social media, marketing, or customer trust materials.

 

Macua Tours will not use private travel documents, passport images, payment information, medical information, or sensitive booking details for marketing.

If you previously authorized us to use a testimonial, photo, or similar content and later want it removed where reasonably possible, contact [email protected].

20. Intellectual Property

The macuatours.com website, including text, images, graphics, logos, page layouts, service descriptions, route descriptions, itineraries, and brand materials, is owned by Origami Passage Holdings LLC or used with permission from licensors or contributors.

 

You may not copy, reproduce, scrape, republish, resell, modify, distribute, or use website content for commercial purposes without prior written permission from Macua Tours.

21. Complaints, Service Issues, and Chargebacks

If you experience a service issue during your trip, contact Macua Tours as soon as reasonably possible so we can try to assist while the service is still active.

Formal complaints should be submitted in writing to [email protected] within 30 calendar days after the service date or trip completion, where reasonably possible. This helps us review communications, supplier records, payment records, and service details while the information is still available.

 

Before initiating a chargeback or bank dispute, we ask that you contact Macua Tours in good faith so we can review the issue and attempt to resolve it directly.

If a chargeback or payment dispute is initiated, Macua Tours may submit relevant booking records, communications, invoices, payment confirmations, supplier coordination records, proof of service delivery, and accepted policies to the payment processor, bank, card network, or dispute review process.

 

Nothing in this section limits any legal rights you may have under applicable law or your payment provider’s rules.

22. Relationship With Other Policies

These Terms are read together with the Privacy Policy, the Cancellation & Refund Policy, and the written quote or booking confirmation for your specific booking.

The Privacy Policy governs how personal information is collected, used, shared, protected, and retained.

 

The Cancellation & Refund Policy governs cancellation requests, refund eligibility, transaction fees, non-recoverable supplier costs, force majeure, no-shows, traveler documentation issues, denied boarding, denied entry, services already commenced, and rescheduling.

 

The written quote or booking confirmation governs the specific services, dates, route, price, inclusions, exclusions, and special written conditions for your booking.

If there is a conflict between these Terms and a specific written booking confirmation, the written booking confirmation controls the specific booking details. These Terms control all general terms not specifically modified in writing.

23. Governing Law

These Terms, and any dispute arising from or related to them or to services coordinated by Macua Tours, are governed by the laws of the State of Wyoming, United States, to the fullest extent permitted by applicable law.

 

Nothing in these Terms limits any non-waivable consumer rights, mandatory legal protections, or remedies that may apply under the laws of your country or state of residence.

24. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will remain in effect.

25. Updates to These Terms

Macua Tours may update these Terms from time to time. The “Last Updated” date will be changed when updates are made.

 

Updated Terms apply from the updated effective date. Bookings confirmed before an update remain governed by the Terms in effect at the time of booking confirmation, unless a change is required by law or agreed in writing.
